The discussions focused on 3 areas:  </p> <ol><li>The negative impact that rest area commercialization would have on blind entrepreneurs across the country;</li> <li>Problems with DoD contracting that create a disincentive for contracting officers to award troop dining contracts to Randolph-Sheppard; and,</li> <li>Problems in the Department of Education’s administration of the Program.</li> </ol><p>  The rest area commercialization issue is one that is not new; however, it picked up steam this year when President Trump included the idea in his much anticipated infrastructure plan.  If Congress enacted this proposal, approximately 400 blind entrepreneurs who operate vending at these rest areas could be displaced and lose their livelihoods.  The goal was to make sure members knew exactly how blind people could be harmed by such legislation.<em><strong> <a href="/sites/blindmerchants.org/files/2022-02/2018-Fly-In-Issue1-Rest-Areas.pdf" rel="noopener" target="_blank">Important: please click here for Commercialization Fact Sheet&gt;&gt;</a></strong></em> The second issue related to Department of Defense contracting.  Due to a quirk in the law, there is a disincentive for DoD contracting officers to award troop dining contracts to Randolph-Sheppard.  The contracting officers have quotas they have to meet in terms of awarding contracts to small businesses.  State Licensing Agencies are not small businesses so giving a contract to the SLA is the same as giving it to a large corporation.  NABM would like to see that changed since in reality the contract is being managed by a small business owned by a blind person.<em><strong> <a href="/sites/blindmerchants.org/files/2022-02/2018-Fly-In-Issue2-DoD-Contracting.pdf" rel="noopener" target="_blank">Important: please click here for DoD contracting  Fact Sheet&gt;&gt;</a></strong></em> The third issue related to the Department of Education’s failure to promptly issue convening letters for arbitration panels or to approve state BEP rules in a timely manner.  These failures are creating a hardship on blind vendors and SLA’s alike.  The goal was simply to ask Congress to make Education do its job. <em><strong><a href="/sites/blindmerchants.org/files/2022-02/2018-Fly-In-Issue3-Education.pdf" rel="noopener" target="_blank">Important: please click here for Department of Education's  Fact Sheet&gt;&gt;</a></strong></em> It was a great experience and a productive one as dozens of blind entrepreneurs trekked to The Hill for their first time.  Canes and dogs were evident everywhere.  No one can tell the story of Randolph-Sheppard better than those who live it everyday.    </p> <p style="text-align: center;"><strong><span style="color: #ff0000;"><em>The National Federation of the Blind knows that blindness is not the characteristic that defines you or your future. and</p> <p>WHEREAS, in 1982 Congresswoman Barbara Kennelly of Connecticut recognized the opportunity that existed for blind entrepreneurs at interstate rest areas and subsequently introduced the “Kennelly Amendment” to the Surface Transportation Act, which authorized state licensing agencies designated to administer the Randolph-Sheppard Program the priority to operate vending machines at interstate rest areas; and</p> <p>WHEREAS, because of the passage of the “Kennelly Amendment,” today, 20 percent of blind entrepreneurs who participate in the Randolph-Sheppard Program operate vending machines at interstate rest areas nation-wide; and</p> <p>WHEREAS, the livelihood of these approximately four hundred blind entrepreneurs is now being jeopardized by Congressional efforts which seek to commercialize these interstate rest areas, most recently with the introduction of H.R. 1990 in the 115th Congress by Congressman Jim Banks of Indiana, which seeks to amend Title 23, United States Code, to allow food concessions at state-owned interstate rest areas; The first ever Louis Braille silver dollar will actually have raised letters embossed on the coin. Congress mandated the minting of the coin, commemorating the 200th anniversary of the birth of Louis Braille. The coin will be released by the United States Mint, in partnership with the National Federation of the Blind, in ceremonies at the NFB Jernigan Institute in Baltimore. There will also be hundreds of coin release events throughout the country. A percentage of sales from each coin go directly to fund targeted Braille literacy programs. I have had the great privilege of working with Ms. LaBreck through the National Council of State Agencies for the Blind. (January 20, 2012): </strong>Thousands of Americans who are blind have embraced the entrepreneurial spirit that helps define our Nation as a land of opportunity. Through the Federal Randolph-Sheppard Vending Facility Program administered by the Department of Education, talented and creative individuals who are blind have acquired the management training and business skills necessary to realize the American dream — a lifetime of economic opportunity, independence, and self-sufficiency for themselves and their families.</p> <p>For 75 years, blind business managers have successfully operated food services and commercial ventures at Federal, State, and private buildings and locations nationwide. We honor and celebrate this program’s historic achievements. We also trust that the Randolph-Sheppard Program will continue to be a leading model for providing high-quality entrepreneurial opportunities for blind individuals. From a simple snack shop, to tourist services at the Hoover Dam, to full food-services operations at military installations, blind entrepreneurs have provided exceptional customer service to Federal and State employees, the Armed Forces, and the general public. With proven ability, they have challenged preconceived notions about disability.</p> <p>The Randolph-Sheppard Act (20 U.S.C. 107 et seq.) created the Vending Facility Program requiring qualified blind individuals be given a priority to operate vending facilities on Federal properties. This program is responsible today for providing entrepreneurial opportunities for over 2,500 individuals who are blind. In turn, these business managers have hired thousands of workers, many of whom are individuals with disabilities. Every American, including persons with disabilities, deserves the opportunity to succeed without limits, earn equal pay for equal jobs, and aspire to full-time, career-oriented employment.</p> <p>Continued support and cooperation are needed from executive departments, agencies, and offices (agencies) to extend the Randolph-Sheppard priority to qualified blind managers through the State licensing agencies that implement the program. Therefore, I direct all agencies that have property management responsibilities to ensure that agency officials, when pursuing the establishment and operation of vending facilities (including cafeterias and military dining facilities) as defined in 20 U.S.C. 107e, issue permits and contracts in compliance with the Randolph-Sheppard Program and consistent with existing regulations and law.
